Craft a successful nursing home negligence claim

When your elderly loved ones need special assistance and you turn to professionals to provide that care, you expect a certain level of care. Unfortunately, some caretakers do not meet that standard.

When improper care leads to injury of your loved ones, you may be able to seek justice through a negligence claim. In order to make the claim successful, there are a few key aspects to consider.

Signs of improper treatment

One of the first and most important elements of the claim is establishing improper treatment. In the case of a nursing home negligence claim, you will have to show abuse in some form. There are a few signs of nursing home abuse that you can identify and use to prove your case, including the following:

  • Bruises, weight loss, bedsores, broken bones and other physical harm
  • Drastic changes or shifts in your loved one's behavior
  • Apparent fear of caregivers or staff members
  • Facility lacking or avoiding communication with family members
  • Lack of staff friendly interaction

Though these are not the only indicating factors, noticing these things early and documenting them can aid in your case.

Witness testimony

A professional medical witness testimony can be very beneficial in proving the right or amount or type of care was not provided. In fact, the court may require such testimony in some cases. Whether voluntary or required, it is important that the witness meet all stipulations in accordance with the law.

Obtaining medical and treatment records is important and can be critical to a claim. The laws regarding accessing someone else's medical records are strict. If the loved one is unable to provide consent to release his or her own medical records, these documents will be available to the person appointed as an attorney in fact or guardian in an advance directive.
